李穆生等涉採購弊案 雄檢依洩密起訴

高雄市政府技監李穆生在環保局長任內涉及勞務採購案弊端，高雄地檢署今(19)日宣布偵結，依洩密罪起訴李穆生及環保局行政秘書曉琴、中山大學環境工程研究所教授樓基中、高雄市立空中大學科技管理系系主任吳銘圳、廠商張至上等5人。

雄檢同案偵辦前雲林縣政府副縣長林源泉、雲林縣環保局長葉德惠涉嫌貪污受賄等7名被告，因犯罪嫌疑不足，予以不起訴處分。

根據檢方調查，李穆生2010年起涉嫌洩密的採購計劃包括「2011-2013年度高雄市加強洗街計畫」、「2011-2013年度高雄市室內空品暨餐飲業輔導計畫」、「2012年高雄市農地控制場址污染改善暨驗證計畫（監督暨驗證標）」等相關標案，因此，以洩漏國防以外應秘密之文書消息罪嫌起訴。

檢方指出，李穆生涉嫌請秘書元曉琴聯繫廠商到高市環保局辦公室，洩漏中山大學教授樓基中、空大系主任吳明圳等評委名單給廠商，再由廠商自行向評委「打點」行賄。

李穆生之前曾因地勇案而備受爭議，在前行政院副秘書長林益世向地勇選礦公司負責人陳啟祥索賄事件中，高雄市環保局在地勇案中的角色受到質疑，李穆生因此請辭局長，轉任市府技監。

李穆生是中山大學環境工程研究所博士，1989年公務人員環境工程高考榜首，在台南縣前縣長陳唐山、蘇煥智任內當了8年環保局長，任內涉及兩弊案，最後都判無罪全身而退，調任經濟部加工出口區管理處組長，高雄市長陳菊看重他的環保專業，延攬他擔任局長。
