學者李明璁因「野草莓運動」被控違反集遊法，台北地院今天認定李並非首謀，且引用釋憲精神，本案為緊急偶發集會，不用事先申請許可，因此判無罪。

李明璁等多名學者、學生，為抗議民國97年11月第2次江陳（海基會董事長江丙坤、海協會會長陳雲林）會期間警察執行維安過當，自同年11月6日起於行政院前靜坐抗議，但因屬非法集會而遭警方驅離，其後抗議者將行動命名為「野草莓運動」；李明璁則因被認為位居「首謀」，於98年6月遭依違反集會遊行法第29條起訴。

北院指出，審理期間經裁定停止審判並聲請釋憲，大法官今年3月間做出第718號解釋認定，集遊法第8條關於室外緊急性及偶發性集會遊行採「許可制」，造成過度限制，不符合憲法保障集會自由的意旨，宣告違憲，從明年元旦起失效，應由立法者修法。

法官依照相關證據認定李明璁並非首謀，且引用釋憲精神，本次集會應屬緊急性及偶發性，不須事先申請許可，判李明璁無罪。全案可上訴。(中央社)
