勞動節放不放假？　勞動部：國定假日該放

明天是五一勞動節，許多勞工朋友對於五一勞動節到底有沒有放假「霧煞煞」。勞動部表示，勞動節是《勞基法》第37條、該法施行細則第23條規定的應放假之日，也就是國定假日，僱主應依法給假並給薪，若僱主徵得勞工同意於該日上班，工資應加倍。
 
勞動部解釋，若是周休二日的勞工，如僱主認定勞動節已被挪移去當成其他周六休假，則勞動節當天就可不再放假。但官員強調，僱主須明確解釋五一勞動節是如何挪移到假日，如無法說明則仍需給補假，勞工遇爭議可向各地勞工主管機關申訴。（唐鎮宇／台北報導）
