網路買到餿油食品　逾7天鑑賞期仍可要求退費

劣質豬油事件愈演愈烈，有民眾在網路買到有問題須下架的食品，但業者稱依《消保法》規定，商品售出逾7天可不退貨退費。消保處說，由於該商品是有瘕疵的，依《民法》規定，消費者可主張解約退費，不受《消保法》限制。

消保處消保官王德明說，劣質豬油事件爆發後，用到劣質豬油的商家、業者忙著退貨，但民眾在網路上買到以劣質豬油製成的食品，卻遇到業者端出《消保法》、拒不退貨退費，令消費者投訴無門。
他說，《民法》規定很清楚，即使消費者在網路購買的瘕疵商品已超過《消保法》規定的7天解約權時限，仍可得依《民法》規定，要求業者解約退費。若業者堅不退貨退費，消費者可向各地消保官投訴，消保官會出面與業者斡旋。（戴安瑋／台北報導）
